Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the membership portal, WhatsApp channel and related services (together, the "Services") provided by Elites Boda TransCoop Society Ltd ("Elites Boda", "we", "us"), a registered Transport Cooperative Society based in Kakamega, Kenya, with the platform technically operated on our behalf by MooreTech. By registering for or using the Services, you agree to these Terms.

2. Membership Eligibility

Membership is open to boda boda riders and community members aged 18 or above who complete our registration process and provide accurate identification and contact information. We may verify the information you provide and decline or suspend membership where information is false or incomplete.

3. Services Provided

Through the platform, members may access:

• Savings, group contributions and credit facilitation via the Society.
• Personal Accident Cover (CIC Jilinde Policy), underwritten by CIC Microinsurance Ltd.
• Last Expense / Funeral Cover, underwritten by KCB Bancassurance and APA Insurance.
• SHA (Social Health Authority) registration and payment facilitation.
• Road-safety initiatives, including the Face of Road Safety Kenya pageant.

Insurance and government-linked services (SHA, NTSA) are provided by their respective underwriters or authorities and are governed by those parties' own policy documents and regulations. Elites Boda facilitates enrollment and payment but is not the underwriter of these products.

4. Contributions & Payments

Contributions are made via M-Pesa to our registered shortcode and are recorded against your member account once confirmed. It is your responsibility to ensure payment references match your member details so contributions are correctly credited. Except where required by law or by the terms of a specific insurance policy, contributions and premiums are non-refundable once processed.

5. Member Responsibilities

• Keep your account credentials and phone number confidential and up to date.
• Provide accurate registration, next-of-kin and payment information.
• Notify us promptly of any unauthorized access to your account.
• Use the Services lawfully and not for fraudulent claims or payments.

6. WhatsApp Communications

By providing your phone number, you consent to receive account statements, contribution confirmations and service updates from us over WhatsApp, using the Meta WhatsApp Business Platform, in addition to email and SMS. You may opt out of non-essential messages at any time by contacting us.

7. Limitation of Liability

We facilitate access to third-party insurance and government services in good faith but are not liable for claim decisions, payouts, or service outcomes determined by those underwriters or authorities. To the extent permitted by law, our liability for issues arising from the portal itself is limited to the value of the affected contribution or transaction.

8. Suspension & Termination

We may suspend or terminate membership access where these Terms are breached, information provided is found to be false, or as required by cooperative-society regulations. You may request closure of your membership at any time by contacting us; outstanding contributions or obligations remain payable.

9. Governing Law

These Terms are governed by the laws of Kenya, including applicable Cooperative Societies and Data Protection legislation. Any disputes will first be addressed through our internal grievance process before recourse to the courts of Kenya.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
